Subject: FCC moving toward Tauzin-Dingell as *compromise*

Declan:

The final draft of the FCC's unbundling rules rollback implements provisions of the Tauzin-Dingell bill as a supposed *compromise*.

The Commission will vote on the rules February 13th at an open meeting.

The public comment period ends on Thursday (6th). pulver.com arranged for telecom entrepreneurs and leaders in the Internet community to sign a letter in opposition to the rule changes.

The opposition letter focuses on the flawed premise motivating the rule changes - the FCC needs to *incent* the Bell companies to invest.

The letter points out Tauzin-Dingell conflicts with the precedent established by the Supreme Court in the TELRIC case - Bell company costs cannot serve as the basis for pricing policy.

Going against the Supreme Court makes it certain the rule changes will encounter court challenges.
