Declan,

The judge has issued a temporary order allowing him to return to school.
Also, the school administration is making statements to the effect of "we
can't really tell you everything that's going on, but it's not just about a
web site." -- making it sound like this is a case of 'insubordination.'

BTW, the original news story URL isn't up any longer. These looked like
significant clips from the one that is up:

"Volk admits that he agreed in early January not to post the list on his Web
site when Davis learned about his plans and ordered him not to. Davis also
asked him to turn over the disposable camera he used to take pictures of the
girls during class time.

"Volk said he changed his mind last week because he believes he has a legal
right to publish what he wants on his private Web site. He said he didn't
turn the pictures over to the principal because they were taken with his own
camera.

"However, Volk said he took the feature off the Web site two days later
after a parent of one of the girls threatened to sue.

....

"He said Davis initially charged him with insubordination for posting the
feature on the Web site against his earlier orders.

"But Volk believes the principal changed his tune in a hearing with Dunn
Monday. He thinks the principal downplayed the Web site issue, possibly
because it's a First Amendment freedom of expression topic, and instead
stressed Volk's earlier behavioral problems.

If I read correctly, the URL for his site is
http://www.geocities.com/wholefnsite2002/screwed.html, but Geocities is
displaying an 'exceeded it's daily limit' message right now. Maybe somebody
can grab it and mirror it.

Student returns to GFH after judge rules
By JENNIFER PEREZ
Tribune Staff Writer

A District Court order allowed a 17-year-old high school senior who
triggered a student First Amendment rights protest earlier this week to
return to class Thursday.

A district judge has temporarily stopped school officials from keeping Kenny
Volk from attending Great Falls High, saying that doing so might violate his
rights to free expression and to due process.
[...]
Macek granted the temporary order Thursday pending a hearing Tuesday in
District Court on making the order permanent.
