"High Court Takes on 'Virtual' Child Porn"
USA Today (01/23/01) P. 3A; Biskupic, Joan

The Supreme Court has announced that it will hear a challenge to
the Child Pornography Prevention Act, the five-year-old federal
law that outlaws the possession or distribution of visual
materials that appear to depict or give the impression of
depicting children engaging in sexual acts. The law aims to curb
the use of imaging technologies to produce images that simulate
children involved in sex acts, even if the pictures are not of
real children. The Free Speech Coalition pursued a legal
challenge to the act in a California federal court, arguing that
the law was too sweeping and unfocused in its scope. The
California court rejected the challenge, but the 9th U.S. Circuit
Court of Appeals subsequently ruled that the law endangered free
speech because of its vague language. The challenge to the law
will come before the Supreme Court this fall.
