You have already got lot n lots of advise on this... just think what will happen..if ur friend leave the organization with in few days..or months.. if the next CTO/Admin conducts forensics/log analysis.....Even your old CTO may not save you.
As the CTO is ur friend ...talk to him and get signed in legal docs... also as John said "Dont try anything new in Live environment"...
