It *is* a criminal offence under extensions to the original CMA1990 in the
Police and Justice Act 2006. The maximum penalty was also increased to two
years imprisonment.

But the relevant sections of PJA 2006 are not in force yet, nor is there any authoritative prediction of when they will be. (If I had to guess, I'd say "at least another six months").
