Public Knowledge tells FCC to revamp broadband laws to avoid constant court battles

While big business trade groups warned the FCC against changing the legal framework around broadband, public interest 
groups say it is the only option.

The FCC will have a hard time enacting net neutrality rules with broadband in its current statutory framework. And 
trying to to do so will set the agency up for a host of law suits, similar to the one filed and won by Comcast over 
network management.

Basing broadband policy on the current legal framework, which was struck down earlier this month, would be "at best 
challenging and at worst reckless," Public Knowledge said Monday in its filings at the FCC.

The group continued to say that even though big carriers like Comcast and Verizon say they want to work with the FCC on 
open Internet rules, they will probably challenge the agency "at every turn" for trying to enforce those rules under 
the current framework.

"The FCC should advance a statutory basis for broadband authority that does not require it to engage in complex and 
unproductive legal analysis for each of its orders, each time opening itself to avoidable challenge," Public Knowledge 
said.
