RIGHT! Like does this make MPLS illegal?

Because MPLS does exactly that. Usually Voice packets BTW.

The reality is that when you are dealing with some IP applications  
some bits
are in fact more equal than others and traffic engineering and  
congestion
management is a integral part of any reliable network.

There is a reason you can still get a fast busy signal on the PSTN  
from time
to time ..especially on Mothers day.
