There are really two questions:  policy and mechanism.

The intuitive notion is that the "upload" portion of a route is sender  
pays, with aggregation according to the business relationships of the  
networks, while the "download" portion of a route is receiver pays,  
again according to the business relationships of the networks.

Border routers should have sufficient information to classify traffic  
in this fashion if a backbone provider has a single border router. In  
the usual case that a backbone has multiple border routers then fine  
grained implementation of this rule will require the switches inside  
the network take cognizance of particular customers and their queue  
priority based on usage. It might be more efficient for the customer  
identity to be labeled on the packet at the ingress border router.  
Queue priorities are slowly changing, so it will not require a lot of  
bandwidth or processing to compute them, over and above counting  
packets and binning them to customers. If, as is desirable, traffic is  
counted only when it actually causes congestion, queue processors will  
have to ascertain when they are congested and count packets,  
allocating them to individual customers. This information will have to  
be occasionally aggregated and distributed throughout an AS.

Only those networks (or portions of a network) that are likely to  
become congested need congestion fairness mechanisms in their bowels.  
The likelihood of congestion can be reduced by overbuilding or by  
throttling packet entry to networks that do not implement proper  
congestion control mechanisms.
