What most people don't understand, and I think the source of your concern, is that the action or artifact itself is not what is patented (in most cases, a design patent DOES patent the artifact), but what it's used for. So, waving isn't patentable, but using a wave in the view of a three dimensional sensing array to control a virtual object probably is. IANAL, but I do have a patent pending, and having been through the gauntlet, understand a bit about it.
