Just about the only thing you can do at your desk that is truly private is a live telephone conversation, due to strict wiretapping laws. As Scotts apparently sees it, you have no more right to damage your lungs in your spare time then you do to drop a company laptop off your roof. Controversial? Absolutely. Unlawful?
