That said I am willing to bet that if they are able to actually write a kit
they would be able to eventually track down someone selling them on the web.
If they wanted to put enough time to it that is. 

The knowledge to write a rootkit is OS-specific systems level stuff.
To track someone down on the Internet requires a knowledge set with
essentially no overlap with the former.
Yes, if one is smart enough to do one they can most likely do the
other but the key parameter is knowledge-acquisition time which is
non-fungible.
