This just begs the question, "if you don't care, why are you doing it?" ;) But yes, problems like the "zero tolerance" mess are exactly why you need to look at the plan beforehand, and make sure you can live with what happens (quite possibly all you need is a sane appeals process, where the person can make the case they are reformed). Oh, and pass it by your legal counsel, make sure that you don't inadvertently set yourself up for a lawsuit if you fire somebody....
