It seems that this is not so easy to accomplish. People with experience on these cases and lawyers will give you more details, but this is what I've learned for such scenarios:
I belive that in cases of child pornography, posession is what violates the USC. So by taking posession of the hardware, the University takes on that liability. Don't quote me, IANAL and my memory is murky on this from a few years ago. Personally, I don't believe taking student machines into posession is going to (a) get you anywhere further than if you asked them to give it to you and "let you take a look, (b) not worth the liability. What happens if it gets damaged in transport or in your posession, and (c) nearly impossible given the staff/student ratio, the fact that alot of organizations are requiring students to have their own hardware, and the amount of incidents increasing. -- Eric Pancer :.: Computer Security Response Team :.: DePaul University http://security.depaul.edu/ .:`:.:':.:`:. epancer () security depaul edu pgp: 1024D/7ACBCFF3 C022 4991 41E5 51E7 683C F765 62F7 7F8E 7ACB CFF3 ********** Participation and subscription information for this EDUCAUSE Discussion Group discussion list can be found at http://www.educause.edu/groups/.
