Here Cisco claims a patent application on some various fixes they made to their TCP stack to prevent RST attacks. http://kerneltrap.org/node/view/3085 That's just silly. These days, every design decision you make when writing software can be patented. It's rediculous. When people in our industry get software patents, they should be shunned. Why are people still buying from Sanctum, if indeed, anyone is, since Webinspect is a thousand times better and not run by complete losers who get software patents (I think).
